The board and the managing agent
Every sale here goes through the co-op board. Under Local Law 58 of 2026, for applications submitted on or after July 28, 2026, a covered co-op has 15 days to say whether a package is complete and 45 days to decide once it is, with one 14-day extension and a pause if the board does not meet in July and August. Ask the managing agent early about any flip tax or transfer fee and what the board needs from an estate.
The executor's authority
When the apartment passes through probate or administration, the executor or administrator signs for the estate once Queens County Surrogate's Court has issued letters. The board package and the closing will ask for them. Shares held in a trust follow the trust's own paperwork.
The estate tax lien release
A release of the New York estate tax lien (Form ET-117) is generally needed before the apartment can transfer. The Tax Department puts average processing at three to four weeks for a complete application, plus seven to ten business days for mailing (source).
A value as of the date of death
